Terms of service
Last updated 8 October 2026
These terms cover two things: what you agree to when you order food through mamaPut, and what a kitchen agrees to when it sells through us. Part 1 is for everyone. Part 2 is for customers. Part 3 is for kitchens. Part 4 applies to both.
Please read the part about allergies even if you read nothing else. mamaPut lists food cooked in home kitchens, and no dish can be promised free of any allergen.
1. Who we are and what these terms cover
mamaPut is operated by MAMAPUT LTD, registered in England and Wales, company number 17432221. Registered office: Belmont House, St. Faiths Street, Maidstone, ME14 1LH. You can reach us at info@mamaput.app.
By using our website or our apps, or by placing an order, you accept these terms. If you do not accept them, please do not use mamaPut.
2. What mamaPut is, and who you are buying from
mamaPut is a marketplace, not a restaurant and not a takeaway. We do not cook, prepare, package or, in most cases, deliver any food. Independent kitchens do that: home cooks, caterers, pop-ups and small restaurants, each running their own business.
When you place an order, the contract to supply that food is between you and the kitchen. Our contract with you is to provide the platform, take your payment on the kitchen’s behalf, and pass your order to them. This matters when something goes wrong, and section 12 explains what we will and will not be responsible for.
We check that a kitchen is who it says it is before it can take orders, and we require it to be registered with its local authority as a food business. We do not inspect kitchens ourselves and we are not a food safety authority.
3. Your account
You need an account to order. We sign you in with a six digit code sent to your email address, so there is no password to lose. Keep access to that email address secure, because anyone who has it can sign in as you.
You must be at least 18 to hold an account. Give us accurate details, particularly your delivery address and a phone number the kitchen can reach you on, because a cook delivering your food may need to call you.
4. Placing an order
Prices are set by the kitchen and shown in the app before you order, including any delivery fee and minimum order for your address. The price you are shown at checkout is the price you pay. If a price changes between you building your basket and placing the order, we tell you and ask you to look again rather than charging the new amount.
Placing an order is an offer to buy. The contract forms when the kitchen accepts it, not when you tap the button.
What happens to your card
- When you place the order we hold the amount on your card. Nothing is taken yet.
- When the kitchen accepts, the payment is taken.
- If the kitchen does not answer within 15 minutes, we cancel the order and release the hold. You are not charged.
- If you close the payment screen without paying, the order is cancelled after 30 minutes. The kitchen never sees an unpaid order.
A released hold usually disappears from your statement within a few days, but that is your bank’s timing and not ours.
5. Collection and delivery
Each kitchen chooses whether it offers collection, delivery, or both, and sets its own delivery area, fee and minimum order. Where delivery is offered, the kitchen usually delivers the food itself. We do not run a courier fleet.
Times shown in the app are the kitchen’s own estimate, not a guarantee. A kitchen can tell you it is running late, and you will be notified when it does. If your order has not arrived and you want to chase it, the kitchen’s number is on your order screen, and they are the people who know where your food is.
Someone needs to be there to receive a delivery. If a kitchen cannot deliver because nobody was available at the address you gave, you may still be charged for the food.
6. Changing your mind, cancelling and refunds
You can cancel free of charge at any point before the kitchen accepts your order. After that the cook may already have started, and cancellation is at their discretion.
The 14 day right to change your mind does not apply to prepared food. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 there is normally a 14 day cancellation right for things bought at a distance, but freshly prepared food is one of the exceptions, because it deteriorates rapidly. This does not affect your other legal rights, which are set out below.
A kitchen may turn an order down, for example if it has sold out or is too busy. If it does, you are not charged and any hold is released. If your order was already paid for and is then cancelled, we refund it to the card you paid with. Refunds normally reach your account within 5 to 10 days.
If the food is wrong
Under the Consumer Rights Act 2015 the food you are sent must be of satisfactory quality, as described, and fit for purpose, and any service must be carried out with reasonable care and skill. If something is missing, cold, not what you ordered, or not fit to eat, tell us at info@mamaput.app within 48 hours, with your order reference and a photograph if you have one, or use Help with this order in the app, which stays open for 24 hours after the order. We will look into it with the kitchen and put it right, which may mean a full or partial refund. Nothing in these terms takes away rights the law gives you.
7. Allergies, intolerances and food safety
mamaPut lists food cooked in home kitchens, which share equipment and surfaces between dishes. No dish can be promised free from any allergen. If you have a food allergy or intolerance that could make you ill, please think carefully before ordering, and tell the kitchen directly.
- Dietary and allergen information on a dish is the kitchen’s own statement about their food. We pass it on. We do not verify it and we cannot.
- Where a dish page shows what that dish is usually like, that is general information about the dish, not a statement about the kitchen that is cooking it.
- Put allergies in the note with your order. The kitchen reads it before they cook, and it is shown on their screen with the order.
- Each kitchen is the food business responsible for its own allergen information under UK food law, including Natasha’s Law where it applies to them.
If you have eaten something that made you unwell, please tell us and tell the kitchen, and consider reporting it to your local authority. We take reports seriously and can suspend a kitchen while we look into one.
8. Reviews
You can review a kitchen once you have completed an order with them, and once per order. Reviews must be your own honest experience. We remove reviews that are abusive, dishonest, or that identify someone. A kitchen can reply to a review in public. We do not edit reviews to make a kitchen look better, and a kitchen cannot pay us to remove one.
We may hide a review while we check it, and when we remove one we tell the kitchen why. A kitchen may not offer customers anything in return for a review, write reviews of its own food or of another kitchen’s, or ask us to remove a review because it is unfavourable. Doing so is a breach of these terms, and fake or concealed incentivised reviews are banned by the Digital Markets, Competition and Consumers Act 2024.
9. For kitchens selling on mamaPut
This section applies if you run a kitchen on mamaPut. Sections 1, 2 and 10 to 14 apply to you as well.
Your responsibilities
- You are the food business operator. You must be registered with your local authority and comply with food hygiene and food safety law, including allergen information.
- You are responsible for your own listings: dish descriptions, prices, allergen and dietary information, opening hours, and your delivery area. They must be accurate and kept up to date.
- You must have the insurance appropriate to your business, and any permissions your landlord or local authority requires.
- Accept or decline orders promptly. Orders you leave unanswered for 15 minutes are cancelled automatically and the customer’s money is released.
- Only sell food you have made or are entitled to sell, and do not list anything you cannot legally supply.
Commission and getting paid
We charge a commission on each completed order, agreed with you and shown in your app. It is taken out of the order total, not added to the customer’s bill. Your app shows the gross amount, our commission and your share on every order, before you accept it.
Payments are processed by Stripe, and you will need a Stripe account connected to mamaPut before you can take orders. Stripe pays you on its own payout schedule, directly to your bank. We do not hold your money. Stripe’s own terms apply to your account with them.
Refunds we agree with a customer under section 6 are deducted from your payouts. Where a refund is caused by something we got wrong, we bear it.
Suspension
We can pause or remove a kitchen from mamaPut if it is not registered as a food business, if listings are inaccurate or unsafe, if there is a credible food safety concern, or if orders are repeatedly left unanswered or cancelled. Where there is a risk to someone’s health we may act first and discuss it afterwards. You can leave mamaPut at any time, and we ask that you fulfil orders you have already accepted.
How dishes are ranked
Customers search for a dish, not a kitchen, and results are ranked the same way for every kitchen. When a customer types what they want, the dishes whose name or known aliases match the words come first; among those, the kitchen nearest to the customer is listed first, then the closer match, then the lower price. When there is no search term, the nearest kitchen comes first, then the dishes we mark as a good first taste of a cuisine, then the lower price. We rank by the words first because a customer looking for jollof wants jollof, and by distance next because food travels badly. The filters a customer applies (cuisine, dietary needs, halal, open now, pickup or delivery, how far) narrow the list; they do not reorder it. A customer can choose to re-order the list by distance, by kitchen rating (highest first, unrated kitchens last) or by price (lowest first); the matching words still come first whichever order is chosen, and nothing a kitchen pays or does changes any of them.
A dish appears only while your kitchen is verified, open to orders and not paused, and while the dish is marked available and its allergen information has been given. Nothing else moves a dish up or down: no kitchen can pay for a better place, we do not sell food ourselves, and reviews and commission rates play no part. If we change how results are ranked we will say so here first.
What each side can see
For each order you see the customer’s first name, their note, the delivery address when they chose delivery, and a phone number for that order. You do not see how they paid. We see every order in full, including the messages we send to either side, because we run the service and handle problems with it. A customer’s details are given to you to fulfil that order, not to keep or to use for marketing; our privacy policy covers what we do with them.
If we pause, restrict or end your listing
When we pause your kitchen, take a dish off or close your account we tell you in the app and by email, with the reason and, where there is one, what would put it right. If we end your use of mamaPut for any reason other than a legal duty, a credible safety concern or repeated breaches of these terms, we give you 30 days’ notice. You can question any of these decisions through the complaint route below.
Complaints from kitchens
If you think we have treated you unfairly or got something wrong, or something in mamaPut is not working for you, open a complaint in the app: Settings, then Complain to mamaPut. A person replies within three days, you get a written outcome, and you can add to the thread until it is settled. We keep the figures on complaints and how long they take, as the Platform to Business rules ask. This route is in addition to your right to go to court or, if we both agree, to mediation.
10. Using mamaPut properly
Do not use mamaPut to break the law, to harass anyone, to place orders you do not intend to pay for or receive, to scrape or copy our content, or to interfere with how the service runs. The dish list we publish, including the descriptions and cultural notes, is ours, and you may not republish it as your own.
11. Your information
How we handle personal data is set out in our privacy notice. In short: a kitchen receives what it needs to cook and deliver your order, which is your first name, your phone number and your address for a delivery. It does not receive your email address or your card details, and we never see your full card number.
12. Our responsibility to you
We do not exclude or limit our liability where the law does not allow us to. That includes liability for death or personal injury caused by our negligence, for fraud, and for your statutory rights as a consumer.
Beyond that: we are responsible for providing the platform with reasonable care and skill. We are not responsible for the food itself, for how it is prepared, or for a kitchen’s own acts and omissions, because the contract for the food is between you and them. We are not liable for loss that was not foreseeable, or for business losses where you are using mamaPut as a consumer.
Where we are liable to a customer for an order, our liability is limited to the amount you paid for that order, unless the law requires otherwise.
We do not promise the apps or the website will always be available or free of faults, though we work to keep them running.
13. Changes to these terms
We may change these terms as the service changes. The date at the top tells you when they last changed. If a change materially affects you we will tell you before it takes effect. The terms that apply to an order are the ones in force when you placed it.
If you run a kitchen, we give you at least 15 days’ notice of any change to these terms that affects you, by email and in the app, unless the law requires a change sooner or the change only closes a security risk. If you do not accept a change you may close your kitchen before it takes effect.
14. Complaints, law and where disputes are heard
If you are unhappy with something, please email info@mamaput.app with your order reference. We aim to reply within 5 working days and to resolve complaints within 30 days.
If you run a kitchen, the quickest route is the complaint form in the app, described in section 9.
These terms are governed by the law of England and Wales. Disputes can be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland you can also bring proceedings in your own courts, and if you are a consumer you keep the protection of the mandatory law of the country you live in.
